An audio tape played at the rape trial of a West Point cadet yesterday purportedly recounts a conversation between Kyle Newman and his alleged 23-year-old victim.

A sexual encounter between Newman, 22, and his accuser allegedly happened in Highland Falls on Feb. 7. The alleged victim admits to drinking as many as seven shots of vodka, flirting with Newman and kissing him in bed at 4 a.m. But the woman says she refused to have sex with Newman.

Newman's attorney argued his client stayed with the woman until 7 a.m., walked her to her car and asked her for dinner. Newman's attorney says the two exchanged numbers and even later contacted each other on Facebook.
