A Bronx woman is suing the state to keep the Westchester Square Medical Center open after a state commission targeted the hospital for closure. The commission?s findings became law on January 1, meaning the closure would have to be implemented. However, the Westchester Square Medical Center president is keeping the hospital open pending the outcome of the lawsuit. Bronx resident Mary McKinney has colon cancer and asthma. She says without the hospital she will not be able to survive. McKinney?s lawyers say the commission's recommendations became law without going before the state Legislature for a vote. McKinney has now sued the state over the closure. As a result of the suit, a Bronx judge granted a temporary restraining order against the state. This halts the commission's recommendations from being implemented at Westchester Square Medical Center.
