YONKERS - A group of Democratic legislators want Westchester County Executive Rob Astorino removed, saying he is spending too much time on his run for governor.

Some Democrats on the board claim Astorino is in violation of the county charter that requires a full-time county executive. They want a special election held in 90 days to bring in a new county executive.

During Monday night's County Board of Legislators meeting, the group submitted a resolution to oust Astorino. "The Board of Legislators has the absolute authority to declare an office vacant and set a special election, so if nine people vote for that, that will happen," says County Legislator Ken Jenkins (D).

Republicans say this is nothing more than politics at its worst and point out that former Democratic Westchester County Executive Al DelBello ran for lieutenant governor and won while he was still in office. "There's nothing in the county law that would allow this, this is politics, pure blatant politics, it comes from the governor's office, they are trying to play politics here," says County Legislator Jim Maisano.

Jessica Proud, a spokesperson for Astorino, agreed saying, "This is the kind of partisan games that people hate."

The resolution is now in the hands of the Committee of Legislation. Even if it passes, the resolution is non-binding because state law allows incumbents to run for higher office.
