Greenburgh embroiled in legal battle with family over man’s death

The Town of Greenburgh and the mother of a man who died during a police arrest are now embroiled in a legal battle.
In the year since the death of Yonkers school aide Jonathan Maldonado, 21, his mother Nancy says she has struggled to come to grips with the situation.
The Maldonado family stood outside federal court in White Plains as they announced a $20 million lawsuit against the Town of Greenburgh and the Greenburgh Police Department, saying police use of excessive force led to Anthony’s death.
Police were attempting to detain Maldonado for allegedly stealing a cellphone from a Best Buy in Hartsdale.
Police released Maldonado's autopsy results for the first time Wednesday, which reveal that he died from a deadly mix of fentanyl and heroin.
Greenburgh's town supervisor also chimed in, calling the suit frivolous.
"We think there's no chance they'll be successful," says Town Supervisor Paul Feiner. "It was an autopsy that indicated the cause of death had nothing to do with the police action."
Despite the back and forth, Nancy Maldonado insists this case is not about money. She says it's about standing up for her son.
"He wouldn't expect less. He knows his momma is a fighter," says Nancy Maldonado."This is very difficult, I'm doing it for him."
The attorney general's office is leading an investigation into Maldonado's death.
