Elizabeth Weinstein was released from Westchester County Jail on Friday, but she’s not free on bail. 

The Westchester District Attorney’s Office tells News 12 that Weinstein was found incompetent to stand trial and is now in the Rockland Psychiatric Center.  

Weinstein has been incarcerated and held on $50,000 cash bail since July after she was charged with several misdemeanors in Briarcliff for allegedly breaking a family court restraining order.

The DA’s office says those charges against Weinstein will be dropped after she completes psychiatric treatment, as a matter of law.   

Other misdemeanor charges against Weinstein in Rye and Suffolk County are still pending but could also be dropped because of the competency exam findings, according to Westchester officials.  

Weinstein told News 12 by phone that she is competent and understands the charges against her. She has refused the exam for months. 

Weinstein says she feels she’s been wrongfully incarcerated and is now being wrongfully remanded for mental health treatment.  

The high-profile family-court-turned-criminal case has garnered intense scrutiny and interest for months since News 12 first reported on the Westchester mother’s incarceration for a mental health examination. 

Critics say Weinstein should be held accountable for allegedly breaking court orders. 

Supporters, however, say Weinstein is embattled in a multimillion-dollar divorce and is a victim of the family court system. 

They argued her bail was unreasonable for alleged nonviolent crimes and raised concerns with a family-court appointed financial guardian who allegedly failed to post Weinstein’s bail.  

The Westchester District Attorney’s Office says Weinstein was also given the opportunity to post $100,000 bond or $75,000 partially secured bond. 

An attorney for Weinstein’s estranged husband had no comment.
