WURTSBORO - The brother of Sullivan County Judge Frank LaBuda accuses the judge of running him over with an ATV.

Peter LaBuda, of Wurtsboro, says that his brother Frank put him in the hospital Sunday with a broken leg and broken ribs.

"He dragged me a few feet," he says. "Around 6 feet or something like that and ended up crashing it."

The 60-year-old claims his brother  purposely ran him over with the vehicle "two times" on their property along Moss Rock Road amid an ongoing family dispute.

Judge LaBuda is still on the bench, according to his secretary. He reportedly claims the entire incident was an accident.

The case is reportedly under investigation by the Sullivan County Sheriff's Department.

Peter LaBuda has since been released from the hospital and says he hopes to put the incident behind him.
