YONKERS - Yonkers residents opposed to a plan to build a CVS pharmacy at the site of the A&P supermarket on Nepperhan Avenue are celebrating a bittersweet victory today.

A judge's decision, made Thursday in federal bankruptcy court in White Plains, approves the nearly $5 million sale of the A&P store on to the drug store chain CVS. The judge’s ruling says that CVS can take over the property, but share the location with the Key Food supermarket chain.

The court ruling follows weeks of protests and a petition driven by area residents who did not want the CVS Pharmacy to move in. They argued that, with a Walgreens right across the street, a full -sized supermarket within walking distance is what they need. 

"I think it’s ridiculous because you got Walgreens right across the street," says resident John Young.

Some residents are concerned that most of the property could still end up being a drug store because the judge in the case says there's no way for him to determine how much of the store is set aside for groceries and how much for pharmacy products
