KIRYAS JOEL - The fate of a turf war in Orange County is now in the hands of a state Supreme Court judge.

A 28-page Supreme Court lawsuit claims expansion plans in the ultra-Orthodox village of Kiryas Joel are based on a flawed environmental review.

Similar concerns from Monroe neighbors fell on deaf ears last month when their board gave Kiryas Joel 164 acres of land.

Activist John Allegro says he's not surprised Orange County joined nine villages and towns taking the land deal to court.

Despite environmental concerns and local efforts to stop expansion plans in Kiryas Joel, construction continues and so does state approval pushing plans ahead.

According to published reports, the Department of Environmental Conservation gave Kiryas Joel the green light Friday to tap into the New York City-Catskill Aqueduct. A representative for the DEC says the permit is for a new well.

News 12 reached out to Gov. Andrew Cuomo, but he has not yet returned calls. A representative for Kiryas Joel had no comment Tuesday on the lawsuit or water permit.

A special vote for residents affected by the annexation will be held next month.
