SPRING VALLEY - A federal court has tossed a lawsuit against the East Ramapo Central School District alleging that students suffered because of favoritism shown to private religious schools including yeshivas.

The class-action lawsuit filed in 2014 alleged that the East Ramapo School Board illegally funneled taxpayer money to private yeshivas through payments for special-education services.

One part was brought by taxpayers; the other by parents, with individual students as plaintiffs. In a 3-1 decision this week, judges on the U.S. Second Circuit Court of Appeals agreed with the district's lawyer's contention -- that the students did not have grounds to sue.

A spokesman for the school board tells News 12 that it will not comment on the ruling. But a lawyer representing the parents says the ruling is both significant and unfortunate.

The next step could be an appeal to the entire Second Circuit Court of Appeals or to the U.S. Supreme Court. East Ramapo parents now have 30 days to make that decision.
