Officer's testimony in fatal Pace student shooting released

A Pleasantville police officer's testimony of what happened the night he shot and killed Danroy Henry nearly two years ago has been released.The 227-page deposition

WHITE PLAINS - A Pleasantville police officer's testimony of what happened the night he shot and killed Danroy Henry nearly two years ago has been released.

The 227-page deposition was given in White Plains Federal Court two weeks ago, with the transcript being released last night. Officer Aaron Hess gave his account of the events of Oct. 17, 2010.

Hess describes how he arrived at a Thornwood bar after a fight spilled into the street. According to Hess, Henry was parked in a fire zone when he heard the engine rev and another officer yell, "Stop that car."

Hess says he stepped in front of the moving car, held up his left hand, shouted for the driver to stop and unholstered his gun. The officer says he didn't move out of the way because he thought the driver would stop. By the time he realized the vehicle was not stopping, the officer says he lunged forward as the car hit his legs. He ended up on the hood and began firing into the car.

Henry died from the gunshot wounds. A grand jury cleared Hess of any wrongdoing in the case, but Henry?s family filed a federal civil suit. In addition, Henry?s teammates, also at the bar, filed a civil suit, claiming they were brutalized by police the same night.
