YONKERS - A fourth-grader from a Yonkers public school has been charged with criminal possession of a weapon after an unloaded gun was found in his backpack Tuesday afternoon.

Police were called to School 13 on McLean Avenue around 3:30 p.m. after a student spotted the pistol in a backpack and told a teacher.

The 9-year-old was released into the custody of a parent and will head to family court to face the criminal charges against him.

He's also been suspended from school.
