A Pomona homeowner is filing a lawsuit against Suez Water following a water main break that allegedly damaged his driveway.

The incident allegedly happened in 2017, but Todd Feiertag says the company refuses to pay for the damages.

In a letter, the insurance company representing Suez Water says there’s no evidence of its water main falling short; therefore, it says it isn't legally responsible. 

However, Feiertag believes otherwise. He tells News 12 he’s on a fixed income and cannot afford to repair the driveway costs at nearly $4,000.

The homeowner plans to take the company to small claims court for the maximum amount allowed, which is $3,000.

Feiertag compares the situation to David and Goliath. “A senior citizen against a multibillion-dollar monopoly who feels they can damage someone’s property and get away with it,” says Feiertag.

Suez Water issued a statement to News 12 that says if Suez is responsible, then the claim will be paid accordingly.
