Daniel Parker, Joseph Garcia and Yves Delpech had been charged with resisting arrest and disorderly conduct after police say the trio interfered as officers were trying to administer aid to Henry. Joseph Romanick faced a charge of felony mischief, which was later reduced, after he allegedly smashed a nearby storefront window following the shooting.
"You're leaving here as the day you came in, without a criminal record," said Judge Robert Ponzini to the students today.
After leaving the courtroom to the sound of applause, the four students said they are relieved their criminal records got wiped clean, but added that it won't bring back their friend.
Henry's mother, Angela Henry, had been supporting his friends through their ordeal. She sees today's decision as an answer to many prayers.
"We are just taking one step to move forward to accountability for the killing of our son and for the treatment of these young men," she said.
A grand jury chose not to file criminal charges against the Mount Pleasant and Pleasantville police officers who opened fire on Henry outside Finnegan's Grill.
The four students and others who were present during the shooting are now filing a lawsuit against Westchester County and the Mount Pleasant and Pleasantville police departments. They are seeking millions of dollars in damages. Their attorney says she intends to sue every police officer who was at the scene.
