The New Rochelle police sergeant accused of raping a teenage girl was in court Monday to give a DNA sample.

Sgt. David Rodriguez pleaded not guilty to first-degree forcible rape in March. A 17-year-old girl claims when Rodriguez responded to a domestic dispute call at her home, he later returned and raped her.

During his court appearance Monday, the district attorney required Rodriguez to submit a DNA sample to compare with a piece of gum found inside the alleged victim?s apartment. The teen claims Rodriguez gave her the gum during the alleged rape.

Rodriguez?s attorney says there was no need for the DNA sample because all it will prove is that his client gave the teen a piece of gum. The attorney says the DNA sample will not prove that Rodriguez raped the teen.

The DNA sample was sent to a lab for tests. Rodriguez is due back in court on April 17.
