Surveillance video prosecutors once hoped would help convict a group of Hispanic teens in a parking lot brawl has led to the dismissal of charges.

A judge recently threw out the Rockland County district attorney's case, saying it would be "in the interest of justice." The videotape, taken from a camera at a Nanuet White Castle in February of 2006, showed four white teens allegedly beating up Jose Diaz and other Hispanic men.

The video also showed Diaz nearly getting run over by an SUV. However, Clarkstown police arrested Diaz and two of his friends rather than the white teens.

"I'm happy it's over ... We went to jail, had to pay $7,000," said defendant Carlos Guzman.

Defense attorney William Girard believes the case should have been dismissed in 2006, but said the DA's office claimed it needed more time to interview people.

Girard is considering suing the police department, DA's office and the group of teens on behalf of his clients.
