Mount Vernon man found not guilty in fifth retrial

A Mount Vernon man has been found not guilty in his fifth retrial on double murder charges.

Selwyn Days was accused of killing an Eastchester millionaire and his home health aide in 1996. The victims in the case were 79-year-old millionaire Archie Harris and home health care aide Betty Ramcharan. Both were found beaten and strangled in Harris' Eastchester home.

It took about eight hours of deliberations over two days until the jury ruled there was not enough evidence in the case to convict him

There was no physical evidence linking Days to the murders, but the prosecution had a taped confession that they believed was their smoking gun. The defense attorneys spent the entire trial hammering away at the legitimacy of that tape.  

Over the last 16 years, two juries convicted Days and there were two hung juries This was the first acquittal.
