The United States Attorney's Office for the Southern District of New York is joining a complaint against the Metropolitan Transportation Authority that claims a Bronx subway stop is not compliant with the Americans with Disabilities Act.

The lawsuit, first brought upon by the nonprofit group Disability Rights Advocates, claims the MTA and the New York City Transit Authority violated the rights of commuters with disabilities by not installing elevators at the subway stop at Middletown Road and Westchester Avenue in Pelham Bay.

The suit goes on to allege that the MTA spent $27 million in renovations that included replacing floors, walls, ceilings and stairs leading to the street and platform but neglected to install elevators for people with disabilities, especially wheelchair-bound residents.

Advocates say the MTA's failure to install elevators at the stop also means it failed to meet the needs of the community.
