A U.S. District Court judge denied Lyft's attempt to dismiss a lawsuit filed by a nonprofit group and a disabled woman from White Plains.

The executive director of the Yonkers-based nonprofit Westchester Disabled on the Move was pleased with the judge's ruling. 

"I'm extremely happy because it allows the facts to be presented to the court," says Melvyn Tanzman, executive director of Westchester Disabled on the Move.

The suit alleges Lyft is in violation of the Americans with Disabilities Act and New York state Human Rights law because it does not provide wheelchair-accessible cars in Westchester.

"Our contention is that people with mobility impairments, who cannot transfer to a regular vehicle, are being discriminated against by Lyft by not being able to use their service," says Tanzman.

Westchester Disabled on the Move officials say they are optimistic that the organization will prevail over Lyft. Officials say they also want Lyft to do a better job of educating its drivers on how to deal with people with disabilities.
