The man accused of raping a 12-year-old girl in Middlesex County when he was a minor will be charged as an adult.
Estarlin Reyes-Martinez, 18, of New Brunswick is charged with first-degree aggravated sexual assault, second-degree sexual assault and third-degree endangering the welfare of a minor.
The case has under scrutiny since Superior Court Judge Marcia Silva suggested the assault wasn't ‘especially heinous or cruel,’ and beyond the child losing her virginity, she did not suffer any further injuries.
