Trial continues for Haverstraw parents accused in infant's death
Two parents accused in the death of their infant daughter were in court today for the third day of their murder trial. Michael Aviles and Lisette Cappellan are accused of fatally beating their 5-month-old daughter, Michelle, last January. In court today, it was the lead investigator who took the stand. Haverstraw Detective Terry Collazo testified that he saw marks on Aviles' hands and said the father appeared to be nervous, avoiding eye contact during an interview after the death. Collazo said Aviles admitted to "maybe dropping the child." He said he had a hard time believing Aviles didn't hurt the baby. From the start, the parents have proclaimed their innocence, and their lawyers say the prosecutor can't prove they murdered Michelle. Cappellan's attorney has sought to distance her from Aviles, suggesting he is solely to blame for the infant's death.
Next week, prosecutors may play a videotaped interrogation of Cappellan by police, sources say. Neither of the two are expected to take the stand in their own defense.
