The widow of a soldier from the Hudson Valley is marking a legal victory after getting one step closer to finding out the truth about her husband's death in Iraq.

Siobhan Esposito sued the U.S. Army in federal district court to obtain the transcript from the court martial of Staff Sgt. Alberto Martinez, who was acquitted of the premeditated murders of her husband and another soldier from the Hudson Valley.

Esposito says the Army settled the case last week and is providing her with a copy of the trial transcript. Captain Phillip Esposito, of Pearl River, and Lt. Louis Allen, of Chester, were killed in Iraq in 2005 by a mine explosion that Martinez was accused of rigging.

As part of the settlement, Siobhan Esposito says the Army has also agreed to withdraw its statement in which it denied that her husband was murdered.
