The mother of a Mount Vernon cheerleader who survived an attack that killed Kayla Green is suing the former superintendent of schools, the school district and the city.

The mother claims they failed to stop the ongoing violence in the months and days before the fatal incident.

The lawsuit accuses school officials and security of not acting after a student allegedly attacked and bullied Green and the surviving teen, Mainece Simpson, in July 2021 - nine months before the fatal stabbing.

Simpson's mother also claims the cheerleading group faced vicious attacks in the week leading up to Green's death.

Green was fatally stabbed by a rival cheerleader on April 8, 2022, after the city wrapped up its celebration of the boys high school basketball state championship.

Simpson was injured but survived.

The teen who killed Green was sentenced earlier this year to three to nine years in prison.
Simpson and her attorney are scheduled to hold a news conference about the lawsuit at 12 p.m. Friday.

News 12 reached out to the city and school district for a comment but hasn't heard back.
