The City of Newburgh is launching an internal investigation into the death of a 39‑year‑old man during an attempted arrest, officials said.
The city’s review comes in addition to a special investigation already being conducted by the New York State Attorney General’s Office.
As previously reported, Marcus Burks is seen on police body camera video repeatedly saying “I can’t breathe” while being restrained by officers during the January 1 incident.
Police say the encounter happened after Burks sped off to avoid being pulled over for a traffic violation.
Burks’ family and attorney say his death has been ruled a homicide.
The investigations remain ongoing.
