An autopsy concluded Friday that the off-duty NYPD officer from White Plains shot in a friendly fire incident died from a result of three gunshot wounds.
Eric Hernandez, 24, suffered a severe beating by six men during a dispute at a Bronx White Castle on January 28. Hernandez drew his weapon on a man he thought was one of his attackers and Officer Alfred Toro shot him when he refused to drop his weapon. There was no finding by the medical examiner that the beating contributed to Hernandez?s death. Hernandez died February 8 after being taken off life support.
Authorities say Toro, of Washingtonville, followed proper procedure and was not expected to face charges. Six suspects have been arrested in connection with the assault on Hernandez.
