Vidal says he and his wife agreed to put the baby up for adoption.
However, Rojas is now charged with murder, evidence tampering and endangering the welfare of a child. Detectives say Rojas initially told them a man pressed what she believed was a gun in her back Monday and fled with her boy as she took him to a checkup at Jacobi Medical Center. But authorities say the mother's story changed.

Sources say Rojas claims she dumped the baby in the trash at 98th Street and Northern Boulevard in Queens after he began choking while on a bus. Police are searching Pennsylvania landfills for the body.
