A Massachusetts company will pay a $10,000 penalty stemming from a fatal construction accident in White Plains last June.
The Occupational Safety and Health Administration announced the settlement with Sealcoating.
The accident happened in front of 137 Maple Ave.
One worker was paving the road while another worker was sealing a manhole. The driver of the paving truck did not see him and backed over him.
The 56-year-old victim was pronounced dead at the scene.
The company was cited for one serious violation concerning safeguards when backing up a vehicle.
In the agreement, OSHA says the violation alleged in the citation has been abated.
