Village of Ellenville Police say Markis Herrera is charged with assault of
endangering the welfare of a child and violating an order of protection.
Police say the 3-year-old is now being treated for a skull fracture.
The child had cuts
on his head and a shoe print on the side of face.
Herrera is
scheduled to be back in court Tuesday.
