The Democrat says that people in his county seat wanted him to continue serving because of unfinished work.
He added that there is no law stating he cannot hold both positions.
News 12 found a county law that says legislators cannot hold town or village office at the same time.
"At present, I am gradually winding down my responsibilities as a County Legislator while also embracing the new challenges and opportunities that come with my role as a State Assembly Member," said Wieder in a statement.
Records show Wieder will make $70,500 total as a county legislator and deputy majority leader.
He will make $142,000 as a state assemblyman.
“I think it's something that deserves examination,” said David Carlucci, a former state lawmaker, when asked about elected officials serving two positions. “I think it's something that we should leave up to the voters, but I think it's something that should be examined and discussed and say ‘hey, how do we make sure that our elected officials are doing their job unrestricted, unconflicted and representing our constituents as best as possible.’"
News 12 found that there is a Democrat assemblyman from Long Island also serving as a Hempstead Village trustee.
