The second of the two killers convicted in the murder of Paula Bohovesky is set to become a free man.
Robert McCain is being paroled this week, 40 years after he was convicted of raping and killing 16-year-old Paula Bohovesky as she walked home from work at the library.
Transcripts show that he told the parole board "he cries himself asleep thinking about Paula's family" while defending his innocence, saying, "The truth is that I didn't kill Paula and neither did my co-defendant. The truth is that there's a serial killer running around in that neighborhood at that time, and they are looking for him right now."
McCain's codefendant has already been paroled, and in its decision the parole board says it's granting McCain's release for "expressing remorse."
"The fact they said in their ruling he showed remorse when he denies being the one who committed the offense and blames some unknown serial killer is really quite shocking and enforces my belief that the entire NYS Parole Board needs to immediately resign," says Assemblyman Mike Lawler.
In its ruling, the parole board deemed McCain as a "low risk to reoffend," and factored in volunteer work and a diploma earned while behind bars.
Assemblyman Lawler is now pushing a bill called Paula's Law, which would prevent anyone who sexually assaults and kills someone under 18 from ever being paroled.
"I hope that while in prison he adapted and certainly behaved himself, but that doesn't justify releasing someone who sexually assaulted and murdered a child under the age of 18 years old," says Lawler.
News 12 has reached out to the sheriff's office and the district attorney about McCain's claims that authorities are looking for a serial killer and is waiting to hear back.
