Edgemont is an unincorporated area within the town of Greenburgh.
Supporters say they want more independence from the town, especially when it comes to land use and planning.
Opponents say it would mean a loss of revenue.
The latest ruling from a state Supreme Court judge was issued last Friday.
The judge overturned a decision by Town Supervisor Paul Feiner to reject the latest petition by supporters.
The judge ruled a vote needs to take place within 40 days.
The supervisor says he will appeal.
