Morris Township is being sued for a three-year-old ordinance that mandates electric appliances for any new apartment complex.

The Department of Justice lawsuit states that the Morris Township ordinance restricts freedom to choose gas, oil or propane and potentially could create a high energy bill for consumers.

The lawsuit was put forth by former U.S. Attorney General Pam Bondi, who stated, “Radical environmentalist policies that drive up costs and limit consumer choice will not stand.”

The ordinance only applies to new buildings with 12 or more units, not residential homes.

When approved, the township said the ordinance was “designed and built to reduce overall energy demand and safer to avoid the risk of carbon monoxide poisoning…”

Township officials have not commented on the lawsuit or why a township with limited apartment buildings at all to offer would be targeted.
