New police body camera video is now shedding light on a deadly arrest in Newburgh.
The footage was released by the New York Attorney General’s Office following the incident on New Year’s Day.
Officials say 39-year-old Marcus Burks allegedly fled from police after officers attempted to stop him for a traffic violation.
Authorities say Burks crashed his vehicle on Route 17K before officers from state police and the Newburgh Police Department moved in to arrest him.
According to the Attorney General, officers used pepper spray and a taser during the encounter.
The video reportedly captures Burks saying he could not breathe as he was being taken into custody.
The incident remains under review, with the Attorney General’s Office continuing its investigation.
City officials in Newburgh have also launched an internal review of the arrest.
