The mother of a 7-year-old Bayport-Blue Point School District student has filed a lawsuit against the district, Suffolk County and others, alleging they failed her daughter.

Student Jor’Dynn Duncan told someone at her school that Emily Kelly, her father's partner, had hit her and had thrown food at her, attorney Derek Sells told reporters Tuesday. Sells said, "The school did nothing."

Lawyers for Portia Duncan, Jor'Dynn's mom, said the school and county (DSS and CPS) failed Jor'Dynn.

Jor'Dynn, who was in foster care and living with Kelly, died in December of 2025. She had injuries throughout her body, authorities said. Kelly was charged with murder in connection with the girl's death.

Jor'Dynn's mom is now suing her daughter's school district and Suffolk County for millions of dollars.

The school district and county said they were unable to comment due to pending litigation.
