Eastchester prevails in discrimination and harassment lawsuit from former police officer

A federal magistrate judge has ruled in favor of Eastchester in a lawsuit filed by former police officer Anthony Barberan, according to a 54-page decision issued last month.

Barberan, who is half-Ecuadorian, claimed he faced years of discrimination and harassment at the Eastchester Police Department.

Barberan said he was disciplined, placed on paid administrative leave and ultimately fired on charges of insubordination and incompetence.

The judge determined that Barberan failed to prove his discrimination or retaliation claims.

The ruling further stated that even if he had, the town provided legitimate, nondiscriminatory reasons for its actions against him.

Barberan says he is appealing the ruling.

In a statement, the town said the decision speaks for itself.
