A White Plains judge tossed out three lesser charges Wednesday against a former Mount Kisco police officer in the death of an immigrant.

Judge Lester Adler granted a request from George Bubaris' defense attorney to drop two counts of unlawful imprisonment and one count of official misconduct. Bubaris still faces a second-degree manslaughter charge, to which he pleaded not guilty.

If convicted, Bubaris could receive a sentence of 5-15 years in the April 2007 beating death of illegal Guatemalan immigrant Rene Perez. Bubaris is accused of beating the man then dumping him on a Bedford road.

On Wednesday, the defense called an emergency medical specialist to the stand. The specialist disagreed with the Westchester medical examiner?s conclusion that Perez?s internal bleeding was caused by a punch.

The specialist also testified that Perez?s injury was not catastrophic and that the illegal immigrant could have been bleeding for between six and 36 before he was taken to the hospital.

A forensic pathologist took the stand Tuesday for the prosecution. She testified that Perez was hit with a tremendous amount of force to his abdomen with an object similar to a fist or foot, resulting in internal bleeding. Her testimony backed up earlier testimony from a medical examiner.
