yesterdayA Dutchess County teen who was raped by a 33-year-old FedEx driver in a horrific attack has now filed a lawsuit against the driver and the company in Dutchess County Supreme Court.
Joshua Ginyard, of Poughkeepsie, is currently on parole for the sexual assault in 2021.
“This individual used his role as the neighborhood FedEx guy to have inappropriate contact with these minor children,” says Kathryn C. Collins, the victim’s attorney. “These children are just starting to comprehend what all of this will look like for them for the rest of their lives.”
Ginyard pleaded guilty to criminal sex act for raping the girl, who was then 16, in the Town of Washington. He also pleaded guilty to three counts of endangering the welfare of a minor for allegedly forcing the victim’s 13-year-old sister and their underage friend to witness the attack.
The lawsuit accuses Ginyard, FedEx and Dutchess Parcel Services, Inc. of engaging in negligence, recklessness, sexual assault, forcible imprisonment and intentional infliction of emotional distress of a minor.
Authorities say Ginyard lured the kids into his work truck by offering them marijuana and then refused to let them go until one of the girls complied with his sexual demands. According to the lawsuit, Ginyard turned off the truck’s GPS tracking device during the incident and during other previous encounters with the same group of children.
“To have an individual be able to turn those things off and not have that signal anything to anybody, it’s negligent,” Collins says.
News 12 tried to reach to Ginyard by phone but someone at that number hung up.
Ginyard was fired by FedEx and sentenced to 1 1/2 years in prison. He was released in January. According to the Dutchess County District Attorney’s office, Ginyard will be on parole for seven years.
News 12 reached out to Dutchess Parcel Services, Inc. but they had no comment. A FedEx spokesman says “We are aware of this filing and are reviewing the claims.”
“This affected her life in such a negative way,” says Collins. “The only way I can describe it is heartbreaking.”
