The Westchester County District Attorney's Office says no criminal charges will be filed against the officers involved in a controversial arrest in Peekskill earlier this month.
In addition to the conclusion, the DA's office also released an hour's worth of body-worn camera video.
News 12 reviewed the videos and has determined that some parts may be disturbing for some viewers.
The arrest took place on Dec. 3 at Riverfront Green Park in Peekskill. The video shows the first officer approach Damar Fields, who appears to have his pants down. Throughout the video, Fields appears to refuse police commands. It appears he was tased several times and also struck. At one point, Fields could be seen bleeding from his mouth.
Previous coverage from Dec. 3:
As News 12 has reported, part of the arrest was captured on video and shared online. Peekskill police then referred the incident to the Westchester County DA's office for an independent investigation.
A spokesperson for the DA’s office wrote in a statement, "After reviewing all of the evidence in this case, our office has determined that there is an insufficient basis to pursue criminal charges against any Peekskill police officer involved in the incident."
Community activists are not happy with that finding.
"It looked to me like you were investigating a way to let this cop go," said Darrell Davis.
The DA's office said it reviewed the body-worn camera footage, interviewed an eyewitness, reviewed post-incident police reports and uploaded the footage to social media before coming to the conclusion.
The statement also said the office has recommended that the Peekskill Police Department consider additional training on how to deal with mentally ill or emotionally disturbed persons and on the use of de-escalation techniques.
"Well, you would think that was already in place," said Davis.
Davis tells News 12 that he will continue to seek justice for Fields.
"They know Damar, they know him. Peekskill is a small city. They should have treated him from the beginning," he said.
The DA's office has referred the matter back to the Peekskill police chief for an internal investigation.
News 12 reached out to the police department but did not hear back.
