A Dutchess County man is facing charges in Wappinger for driving while intoxicated with children in the car, according to authorities.

State police say Moises Centeno Vargas, 49, from Fishkill, was pulled over by a trooper on July 4 while driving southbound on Route 9 in the Village of Wappinger.

The trooper noticed signs of intoxication and found an 8-year-old and a 10-year-old inside the vehicle. Police say Vargas failed standardized field sobriety tests and was arrested.

Vargas was taken to the state police barracks in Wappinger, where authorities say he provided a breath sample showing a blood alcohol concentration of 0.14 percent.

The children were released to a sober third party.

Vargas was charged with Leandra's Law, driving while intoxicated and driving with a bloodalcohol content of 0.08% or higher, according to state police.

He was released and is scheduled to appear in Village of Wappinger Court next month.
