A Port Chester volunteer firefighter remains in ICE custody as questions continue over his immigration status and criminal history.
Milton Guamarrigra, 43, was taken into custody last month.
Immigration officials say he was in the U.S. illegally and was ordered to leave 19 years ago.
His lawyer says he appealed the order, but it was dismissed—and Guamarrigra didn't realize that.
Officials called him a "serial drunk driver" and "a public safety threat."
His lawyer disputes that, saying he only has two DWI convictions, with the most recent arrest in 2005.
There is a pending application for a green card.
He remains in ICE detention in Michigan.
