Court appearance ticket issued to owner of 50 Hale Ave. garage

City of White Plains officials announced on Tuesday that they issued the owner of the 50 Hale Ave. parking garage - 44 South Broadway LLC - a court appearance ticket for an unsafe structure, which is a violation of New York and White Plains building codes.
The news comes following the partial collapse of the garage last Wednesday.
In August 2018, New York state mandated all parking garage owners to perform structural assessments of their parking garages conducted by licensed engineers.
Damon Amadio, the commissioner of Building in White Plains, says the department mailed notices to all private parking garage owners advising them to perform the assessments.
These notices were first sent out in 2018 and later in January 2022 and November 2022 to those who failed to respond.
Commissioner Amadio confirmed that the Building Department had not received reports from around 40 private parking garages.
The Building Department performed walkthroughs for the 40 garages that were missing assessments beginning this past Friday and were concluded on Monday.
Beginning Tuesday, tickets will be issued for those who have not submitted the assessment.
"The initial parking garage structural assessment of the 50 Hale Avenue private parking garage should have occurred in 2019," said the Building Department.
As of Friday, two days after the collapse, the owner of the garage, 44 South Broadway LLC., was issued a court appearance ticket.
While Commissioner Amadio says the Building Department was shown a copy of an assessment report dated 2024, the report was submitted on Oct. 17 of this year.
The cause and origin of the failure is still under investigation.
