A prosecution witness pointed the finger at an accused triggerman Wednesday in a Spring Valley nightclub shooting.
Carlos Herring is accused of killing 29-year-old Don Thompson outside Club Horizen in August 2006. David Davenport, Thompson?s friend, testified he saw Herring repeatedly shoot Thompson. Davenport also admitted he used a box cutter to slash Herring's throat immediately after the shooting.
The defense questioned Davenport?s credibility. Herring's defense attorney reminded the jury Davenport didn't immediately admit the slashing to police. The defense also pointed out that Davenport was convicted of assault five years ago for using scissors to stab someone.
Herring was arrested in Florida and brought back to Rockland County a few days after the shooting. During a hearing in January, an arresting officer testified that Herring admitted to the killing.
