A judge agreed today to consider a request by the attorney of Danroy Henry's family to access 911 transmissions and surveillance video from local businesses, as well as any police radio calls and dash-cam video from the night of the Pace University athlete's death.
Henry, 20, was killed during an encounter with police outside of a Thornwood bar Oct. 17.
News 12 has learned that there may be no dash-cam video from that night as prosecutors have claimed that none of the cameras in the responding police squad cars were working.
The Westchester County District Attorney's Office had earlier denied a request to release any of the materials, saying they could be leaked to the media and could prejudice the jury. The judge is expected to rule Monday on the issue.
"We're happy that the justice took an active interest in helping us resolving the problem of access," says attorney Michael Sussman.
Four others arrested during the incident are expected to be in court tomorrow for charges of obstruction of justice and disorderly conduct. Their attorneys are calling the charges a cover-up of police brutality and are demanding they be dropped.
