Newburgh mom says she was booted out of women’s bathroom for bringing in 10-year-old son with special needs

Newburgh mom Abril Delgado hit record in disbelief Saturday after she and her 10-year-old son were allegedly yelled at and told to leave the women’s bathroom at the Flaming Grill and Buffet on Route 300 in Newburgh. 
The manager is heard on the recording, obtained by News 12, saying, “I’m the manager. You need to let me know first. You cannot bring a boy to the ladies’ room!” 
Delgado says she’s brought her son into other public bathrooms before and never had a problem.  
“He goes into the women’s bathroom with me not because I don’t want him going into the men’s bathroom but because he’s special needs and I need to make sure he’s OK,” said Delgado. 
Delgado’s son as a rare genetic syndrome called Albright’s hereditary osteodystrophy that she says makes him look older and causes cognitive and physical impairments.  
New York state law requires single-stall bathrooms to be gender neutral but in this case, Delgado says the bathroom had multiple stalls. 
Family bathrooms are not required by law in public places either. 
The Americans with Disabilities Act doesn’t cover situations like this either. 
“Places need to make reasonable accommodations so that people have equal access,” said Northeast ADA Center representative Chris Sweet. 
News 12 tried speaking to the manager, but he asked to stop recording once inside the restaurant. 
He said off camera that Delgado was behaving “selfishly” and without concern for the privacy of others for expecting her son to use the women’s restroom. 
Delgado says she hopes to raise awareness to the needs of people with disabilities by sharing their ordeal. 
“I really hope when people see this they think about someone they know who has a disability and see how wrong this is.”
