Former NYPD Sgt. Erik Duran's fate was in the hands of a judge today after being found guilty in February for the 2023 death of Eric Duprey.
A judge sentenced Duran to three to nine years. The New York Attorney General's office requested three to nine years of jail time. Duran's defense attorney said "incarceration is entirely inappropriate".
Duran, from Mahopac, was on trial for Duprey's death during a botched drug bust in Kingsbridge Heights in August 2023. In February he was found guilty on the manslaughter charge but not guilty of criminally negligent homicide.
The incident was caught on surveillance video. It showed Duran, in plain clothes, throwing a cooler at Duprey as he tried to get away on a motorbike.
Duprey was knocked off and killed. Duprey's family says he died an "unfair death".
Black Lives Matter of Greater New York and Duprey's relatives had been pushing for the maximum sentence.
The Sergeants Benevolent Association handed over a petition with over 11,000 signatures calling for no jail time in the case. Duran, who lives in Mahopac with his family, pleaded not guilty in this case.
