A Somers man has been acquitted of murder in a drunk driving crash that killed two people on I-287 two years ago.
The Westchester judge said the 52-year-old driver's action were reckless but didn't rise to the level of depraved indifference, a necessary burden to prove second-degree murder.
Jaime Paucar was found guilty on several other charges, including aggravated vehicular homicide, manslaughter, assault and driving while intoxicated.
Paucar was convicted of driving with a blood alcohol content more than twice the legal limit and driving the wrong way on I-287 before slamming head-on with another car on Jan. 30, 2020.
The driver of the other car, 57-year-old Jordan Wachtell, and his son's friend, 17-year-old Eric Goldberg, were killed.
Wachtell was taking his son and two friends to a basketball game that night in Harrison.
Paucar is scheduled for sentencing on March 28.
