A local lawmaker is hoping to strengthen the battle against the "Pink Tax," or the major price hike in some items marketed for women.

State Sen. Shelley Mayer is a sponsor of New York’s Pink Tax Ban. She says she’s headed back to the drawing board to strengthen the law.

“I am confident women are still paying more,” she says.

Mayer says the biggest reason why this still occurs is loopholes. The law states a business can't charge different prices for substantially similar products, services or brands just because one is for women, but "brand" is a gray area.

"Let's say a razor has a brand for women and a brand for men. That might allow different pricing,” Mayer says.

Mayer says many people also don't know the law exists. As well, residents can't take legal action against companies, only report them.

"The only enforcement of this law is by the attorney general,” Mayer says.

She says the language of her original bill was weakened when it was absorbed into the 2020 budget, but she’s looking to change that.

"I'll consult with the Attorney General's Office and get their impression on whether they're getting complaints…whether I should propose a stronger law so that people know they have a remedy,” Mayer says.
