The 44-year-old is in custody and was released without bail after being charged with disorderly conduct and other federal counts.
Photos of Kelly provided by authorities show him at the U.S. Capitol on Jan. 6.
Federal prosecutors are charging him with obstruction of an official proceeding, aiding and abetting, unlawful entry to a restricted building and violent entry and disorderly conduct.
The complaint includes a number of Facebook conversations by Kelly making comments such a "spread the word, Taking this back by force now, no more bs."
Another said, "I'll be with ex-NYPD and some Proud Boys. This will be the most historic event of my life."
Authorities confirm that the ex-NYPD member is Kelly's brother.
News 12 rang Kelly's doorbell Thursday, but no one was home.
A neighbor said off-camera that they they saw a lot of unmarked cars at the home Wednesday, but wasn't sure why. They also describe Kelly and his family as nice and quiet.
