Court documents reveal Mount Kisco Police Officer George Bubaris may have incriminated himself when it comes to events surrounding the death of a Guatemalan immigrant in April.
Bubaris and his supervisor, Lt. Edward Dunnigan, and another officer, Edward Dwyer, responded when 42-year-old Rene Perez called police from a Laudromat complaining of stomach pain. Perez had a history of drunken 911 calls, and police records show Bubaris reported there was no need for further action. Perez can be seen on surveillance video leaving the Laundromat.
However, the statements that will play a key role in the case is what court records show Bubaris said to his fellow officers, which they in turn shared with prosecutors. Officer Bubaris is absent from the police log for 45 minutes after the Laundromat encounter while Dunnigan and Dwyer go on another call. When the officers catch up with each other about an hour later, court records show Bubaris telling the other officers, ?While you and Dunnigan were on that aided call, I went out hunting around for Rene Perez and I ran into him and I gave him a ride up to Byram Lake Road.? The next day in the police locker room, records show Bubaris told another officer, "You're the only one who knows, bro."Prosecutors say video surveillance tape also places Bubaris near the location where Perez was found in Bedford. That surveillance was part of evidence presented to the grand jury that indicted Bubaris on manslaughter charges. A passerby discovered Perez almost unconscious on the side of that desolate dirt road in Bedford. He later died of internal injuries.Defense attorney Ed Hayes will not say whether his client gave Perez a ride out to Bedford that night or not. ?Even if Bubaris gave him a ride to some place, you don't know if somebody else didn't pick him up and take him someplace else,? said Hayes.
The 30-year-old Bubaris pleaded not guilty to charges of second-degree manslaughter, unlawful imprisonment and official misconduct. He has been released on $100,000 bail and suspended without pay.
